Welcome to Mountain View Nursery. By accessing our website or placing an order through our online store, you agree to the following Terms & Conditions. Please read them carefully before using our website or completing a purchase.

1. About Our Website & Services

This website is operated by Mountain View Nursery. Throughout the site, “we”, “us”, and “our” refer to Mountain View Nursery.

By visiting our website or purchasing something from us, you agree to be bound by these Terms & Conditions, along with any policies referenced on our site, including our Delivery Policy, Refund Policy, and Privacy Policy.

Our store is hosted on Shopify, which provides the e-commerce platform allowing us to sell products and services online.

We reserve the right to update or modify these Terms at any time by posting changes on this page. Continued use of our website after changes are posted constitutes acceptance of those changes.

2. Online Store Terms

By using our site, you agree that:

  • You are at least 18 years old or have permission from a parent or guardian

  • You will not use our products or website for unlawful purposes

  • You will not transmit harmful code, malware, or disruptive software

  • A breach of these Terms may result in immediate termination of service

3. Accuracy of Information & Live Plant Disclaimer

We aim to provide accurate product descriptions, sizing, and images. However:

  • Plants are living products and naturally vary in size, maturity, shape, and seasonal appearance

  • Images may depict mature plants or seasonal growth for reference only

  • Young plants delivered may differ from images shown

  • We reserve the right to update or correct information at any time without notice

If you require specific sizing or plant condition, please contact us before purchasing.

4. Stock Levels, Pre-Orders & Sourcing

If a product is out of stock, our team will contact you to let you know we are sourcing the plant and provide updated expectations for when it is likely to arrive (typically 2–6 weeks if the item is not currently in stock). Occasionally, items may be unavailable due to high demand or seasonal availability.

If we are unable to supply a pre-ordered item, you will be contacted and refunded in full for that item.

Mountain View Nursery sources stock from South Australia, Victoria, NSW, and ACT, and grows a wide range of plants onsite. Availability cannot be guaranteed year-round.

5. Bare-Root Stock — Important Disclaimer

Bare-root plants require specific handling and care. Upon receiving bare-root stock:

  • Check vitality by gently scratching the bark

  • Soak roots in water for 1–24 hours before planting

  • Do not allow roots to dry out

  • Plant in suitable soil or potting mix and mulch well

  • Stake trees until established

Bare-root stock is highly dependent on correct care. We are not responsible for plant health after delivery if care instructions are not followed.

Refunds for transport damage must be requested on the day of delivery. We cannot offer refunds for bare-root stock after delivery due to its perishable nature, subject to your rights under Australian Consumer Law.

6. Prices, Payment & Order Accuracy

Prices may change without notice.

We reserve the right to limit or cancel orders due to availability, suspected resale activity, or errors in pricing or product information.

You agree to provide accurate billing, shipping, and contact information.

Refunds and returns are governed by our Refund Policy.

7. Delivery & Pickup

Delivery is available to selected NSW and ACT postcodes. Delivery details, minimum spends, and fees are listed on our Delivery Areas page.

You are responsible for providing accurate delivery instructions. Failed deliveries due to incorrect information may incur a redelivery fee.

We do not accept returns on live plants unless they are damaged on arrival, subject to your rights under Australian Consumer Law.

8. Special Orders & Deposits

Special orders may require a 50% deposit to secure stock.

Deposit terms:

  • 50% of the total order value

  • Payment via bank transfer or credit card

  • Deposits are non-refundable if you cancel

  • Deposits are refunded in full if we cannot supply

  • Deposits are applied to the final invoice

  • Deposits may be forfeited if you fail to complete the purchase without valid cause

9. Communications (Email & SMS)

By providing your contact details, you consent to receive transactional communications relating to your orders and enquiries.

If you opt in to marketing communications, we may send promotional messages via email and SMS. You may unsubscribe from emails at any time using the link provided in each email. You may opt out of SMS at any time by replying STOP.

Message frequency may vary. Message and data rates may apply.

Your personal information is handled in accordance with our Privacy Policy.

10. Third-Party Links & Integrations

Our website and services may use third-party platforms and integrations, including but not limited to Shopify, Klaviyo, Podium, Google services, and Meta (Facebook and Instagram).

We are not responsible for the content, security, availability, or privacy practices of third-party platforms. Your use of third-party tools and services is at your own risk and subject to their respective terms and policies.

11. Prohibited Uses

You may not use our site or services:

  • For unlawful purposes

  • To violate Australian laws or regulations

  • To infringe intellectual property rights

  • To transmit malicious software

  • To provide false or misleading information

  • To interfere with website security or functionality

We reserve the right to terminate access for prohibited use.

12. Disclaimer of Warranties & Limitation of Liability

We do not guarantee that:

  • The website will be uninterrupted or error-free

  • Plant performance or growth outcomes will meet expectations

To the fullest extent permitted by law, Mountain View Nursery is not liable for indirect or consequential loss arising from use of our website or products.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law that cannot be excluded by law.

13. Indemnification

You agree to indemnify and hold Mountain View Nursery harmless from any claims arising from your breach of these Terms or misuse of our services.

If any provision of these Terms is deemed unenforceable, the remaining provisions will continue in full force.

These Terms apply unless terminated by either party. You may stop using our website at any time. We may suspend or terminate access if you breach these Terms.
