Welcome to Mountain View Nursery. By accessing our website or placing an order through our online store, you agree to the following Terms & Conditions. Please read them carefully before using our website or completing a purchase.

1. About Our Website & Services

This website is operated by Mountain View Nursery. Throughout the site, “we”, “us”, and “our” refer to Mountain View Nursery.

By visiting our website or purchasing something from us, you agree to be bound by these Terms & Conditions, along with any policies referenced on our site (including our Delivery Policy, Refund Policy, and Privacy Policy).

We reserve the right to update or modify these Terms at any time by posting changes on this page. Continued use of our site means you accept any updates.

Our store is hosted on Shopify, which provides the e-commerce platform allowing us to sell products online.

2. Online Store Terms

By using our site, you agree that:

  • You are at least 18 years old or have permission from a parent/guardian.
  • You will not use our products for unlawful purposes.
  • You will not transmit harmful code, malware, or disruptive software.
  • A breach of these terms may result in immediate termination of service.

3. Accuracy of Information & Live Plant Disclaimer

We aim to provide accurate product descriptions, sizing, and images. However:

  • Plants are living products and will naturally vary in size, maturity, shape, and seasonal appearance.
  • Product images may show mature plants, blossoms, fruit, or seasonal colour for reference only.
  • Young plants delivered may differ from the images shown on the website.
  • If you require a particular size or condition, please contact us before purchasing.

We reserve the right to update or correct information at any time without notice.

4. Stock Levels, Pre-Orders & Sourcing

If a plant is out of stock, you may place a pre-order. Pre-order plants typically arrive within 2–6 weeks, depending on growers and availability.

We will contact you if a plant cannot be sourced. If we cannot supply it, you will receive a full refund for that item.

Mountain View Nursery sources stock from South Australia, Victoria, NSW & ACT, and grows a wide range of plants onsite. We cannot guarantee availability for every plant year-round.

5. Bare-Root Stock — Important Disclaimer

Bare-root plants require specific handling and ongoing care.

Upon receiving bare-root stock:

  • Check vitality by gently scratching the bark — green sapwood indicates a healthy plant.
  • Remove the bag and soak the entire root system in fresh water for 1–24 hours before planting.
  • Do not allow roots to dry out at any stage.
  • Use high-quality soil or premium potting mix and mulch well.
  • Stake trees until established.
  • Establishment may take 6–8 months, depending on season and conditions.

Important:
We cannot be responsible for plant health after delivery. Bare-root stock is highly dependent on correct care. If roots are allowed to dry out, the plant may die quickly—even within hours.

Refunds for transport damage must be requested immediately on the day you receive the plant. After that time, we cannot offer refunds for bare-root plants due to their perishable nature.

6. Prices, Payment & Order Accuracy

Prices are subject to change at any time without notice.

We may limit or cancel orders where:

  • Multiple orders are placed under the same account or address
  • Orders appear to be made by resellers
  • Product availability changes

If we make changes or cancel an order, we will attempt to notify you using the contact details provided at checkout.

You agree to provide accurate billing, shipping, and contact information and update it as needed.

7. Delivery & Pickup

Delivery is available to selected NSW & ACT postcodes only. All delivery details, minimum spends, and fees are listed on our Delivery Areas page.

Customers must provide accurate delivery instructions. Failed deliveries due to incorrect information may incur a redelivery fee.

We do not accept returns on live plants unless damaged on arrival.

8. Special Orders & Deposits

We accept special plant orders upon request. Once availability and pricing are confirmed, a 50% deposit is required to secure the order.

Deposit Terms

  1. Amount: 50% of the total order value.
  2. Payment Method: Bank transfer or credit card.
  3. Non-Refundable:
    • The deposit is non-refundable if the customer cancels the order.
  4. Refundable:
    • If we are unable to source or supply the plants, the deposit will be refunded in full.
  5. Application of Deposit:
    • The deposit is applied to the final invoice total once stock arrives.
  6. Forfeiture:
    • The deposit will be forfeited if the customer does not complete the purchase without valid cause.

9. Third-Party Links & Optional Tools

Our website may contain links to third-party websites. We are not responsible for the content, accuracy, or policies of any third-party site.

Any optional tools (Shopify apps or integrations) are used at your discretion.

10. Prohibited Uses

You may not use our site:

  • For unlawful purposes
  • To violate Australian laws or local regulations
  • To infringe intellectual property
  • To transmit harmful software
  • To provide false information
  • To interfere with website security

We reserve the right to terminate access for prohibited use.

11. Disclaimer of Warranties & Limitation of Liability

We do not guarantee that:

  • The website will be uninterrupted, error-free, or fully secure
  • Plant performance or growth will meet your expectations

To the fullest extent permitted by Australian law, Mountain View Nursery is not liable for:

  • Injuries or damages resulting from plant care or planting conditions
  • Loss of plants after delivery
  • Indirect or consequential damages

Your use of our products and website is at your own risk.

12. Indemnification

You agree to indemnify and hold Mountain View Nursery harmless for any claims arising from your breach of these Terms or violation of Australian law.

13. Severability

If any part of these Terms is deemed unenforceable, the remainder will still apply.

14. Termination

These Terms apply unless terminated by either party. You may stop using our site at any time. We may terminate service if you violate these Terms.

15. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.
